The defense sought such an award from the court under Georgia’s offer of settlement rule that was a part of Georgia’s tort reform act back in 2005. Under the offer of settlement rule, if one side makes an offer under the statute to settle the case and it is rejected and the verdict at trial is for 25% more or less depending on who made the offer, then the other side must pay the offering side’s attorney’s fees. In the case decided by the Georgia Court of Appeals, a very low offer was made by the defendant that was rejected by the plaintiff. Plaintiff lost at trial and thus otherwise would be subject to having to pay the defendant’s attorneys’ fees. The Judge used lanaguage in the rule that suggests the court has ultimate discretion whether to award attorneys’ fees and decided not to in this case. In those cases, it seems very harsh to then say, because you lost you owe not only your attorneys’ fees but also the othersides.
